Terms of service

1. Scope

For all orders placed via The Cardboard Co. online shop by consumers and businesses, the following terms and conditions apply.

A) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their self-employed professional activity.

B) Entrepreneurs, merchants within the meaning of the German Commercial Code, legal entities under public law or special funds under public law (hereinafter referred to as "Entrepreneurs") are natural or legal persons or a partnership with legal capacity which, upon conclusion of a legal transaction, acts in the exercise of its commercial or independent professional activity.

The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they only become part of the contract if The Cardboard Co. expressly agrees to them in writing.

2. Contracting party, conclusion of contract

The purchase contract is concluded with The Cardboard Co - a trademark of KOHLSCHEIN GmbH & Co. KG.

By placing the products in the online shop, The Cardboard Co. makes a binding offer to conclude a contract for these products. You can place our products in your shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking the order button. Immediately after sending the order, you will receive a purchase confirmation by e-mail.

3. Contract language, contract text storage

The languages available for the conclusion of the contract are German and English.

We save the contract text and send you the order data and our general terms and conditions in text form. For security reasons, the text of the contract is no longer accessible via the Internet.

4. Delivery conditions

Within Germany we deliver freight-free by our parcel service DPD. DPD does not currently deliver to any Packstations.

It is not possible to pick up the goods yourself.

5. Payment

In our shop the following payment methods are available to you:

Prepayment

If you choose the payment method prepayment, we will give you our bank details in a separate e-mail and deliver the goods after receipt of payment.

Credit card

When you place your order you provide your credit card details. Once you have been identified as the legitimate cardholder, the payment transaction will be carried out automatically and your card will be debited.

PayPal, PayPal Express

In the order process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or first register, legitimise with your access data and confirm the payment instruction to us. After placing the order in the shop, we will ask PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.


PayPal Plus

As part of the payment service PayPal Plus we offer you different payment methods as PayPal Services. You will be forwarded to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you have chosen the payment method PayPal Plus, you have to be registered there to be able to pay the invoice amount or you have to register first and legitimise yourself with your access data. The payment transaction will be carried out automatically by PayPal immediately after confirmation of the payment order. You will receive further instructions during the ordering process.

Credit card via PayPal

If you have chosen the credit card payment method, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment order and after your legitimation as the rightful cardholder by your credit card company at the request of PayPal and your card will be charged. You will receive further instructions during the ordering process.

Direct debit via PayPal

If you have chosen the payment method direct debit, you do not have to be registered with PayPal to pay the invoice amount. With confirmation of the payment order you give PayPal a direct debit mandate. PayPal will inform you about the date of the debit (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is executed and your account is debited. You will receive further instructions during the ordering process.

Billing via PayPal

If you have chosen the payment method invoice, you do not need to be registered with PayPal to be able to pay the invoice amount. After successful address and creditworthiness check and submission of the order, we assign our claim to PayPal. In this case you can only pay to PayPal with debt discharging effect. For the payment processing via PayPal, the general terms and conditions and the data protection declaration of PayPal apply - in addition to our general terms and conditions. Billing by Klarna

After placing your order you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account activated for online banking, you must legitimise yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Apple Pay

To pay the invoice amount via Apple Pay, you must use the browser "Safari", with which service providers Apple are registered, have activated the Apple Pay function, identify yourself with your access data and confirm the payment order. The payment transaction will be carried out immediately after placing the order. You will receive further instructions during the ordering process.

6. Right of withdrawal

For consumers (acc. 1.A):

Consumers are entitled to the statutory right of revocation as described in the revocation instruction - in contrast to entrepreneurs within the meaning of the declaration in § 1 Scope of Application, sentence 2. For further information, please refer to the separate revocation instruction.

Entrepreneurs (acc. to 1.B):

Entrepreneurs are not granted a voluntary right of revocation.

7. Reservation of ownership

The goods remain our property until full payment has been received.

For entrepreneurs (according to 1.B) the following applies in addition: We reserve the right of ownership of the goods until all claims from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from this resale - irrespective of any combination or mixing of the goods subject to retention of title with a new item - in the amount of the invoice amount and we accept this assignment. You remain authorised to collect the claims, however, we may also collect claims ourselves if you do not meet your payment obligations.

8. Transport damage

In principle, the following applies: If goods are delivered with obvious transport damage, please complain to the deliverer immediately about such defects. Document the damage, if necessary with a photo, and have the deliverer confirm this documentation. Please contact The Cardboard Co. immediately. This will help us to be able to assert our claims against the carrier or the transport insurance company.

9. Warranty and guarantees

Unless otherwise expressly agreed below, the statutory law on material defects of the German Civil Code pursuant to §434 ff. BGB

The goods are only guaranteed if this has been expressly stated in the order confirmation.

For entrepreneurs (according to 1.B) the limitation period for justified claims for defects in newly manufactured products is one year from the transfer of risk. The statutory periods of limitation for the right of recourse according to § 445a BGB remain unaffected.

If the delivered item is defective, we shall provide a warranty to entrepreneurs at our discretion by eliminating the defect (rectification) or by delivering a defect-free item (replacement).

Note: The Cardboard Co. products on offer are natural products made from environmentally friendly materials such as paper and cardboard. Natural products basically have the property that colour changes and deformations can occur, as the material reacts to external factors such as humidity, temperature and light irradiation. Such changes are normal and do not constitute a defect.

The legal regulations apply.

11. Final provisions

If you are an entrepreneur (according to 1.B), then German law (HGB) applies exclusively.

If you are a merchant in the sense of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our registered office in Viersen.

If parts or individual formulations of these General Terms and Conditions of Business do not, no longer or do not completely correspond to the applicable legal situation, the content and validity of the remaining parts of the document shall remain unaffected.
